Marigolden Terms of ServiceEffective Date: October 2, 2026These Terms of Service ("Terms") govern your use of marigolden.net (the "Site") and your booking of sessions, classes, events, and coaching (the "Services") offered by Marigolden ("Marigolden," "we," "us," or "our"). By using the Site or booking a Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or Services.1. Eligibility and Age Requirements
1.1 You must be at least 18 years old to use the Site to book or pay for Services, subscribe to our newsletter, or submit information to us. 1.2 The Site is not directed to children under 13. We do not knowingly collect personal information from them. 1.3 A parent or legal guardian must arrange and pay for Services for anyone under 18. The parent or guardian must also sign all required forms and accepts these Terms for the minor. We may require a parent or guardian to attend Services with a minor, and we may decline Services to any minor.2. Nature of Services; Required Disclosures
2.1 Our Services include Reiki, energy work, sound meditation, intuitive movement, group meditation and movement classes, and one-on-one coaching. They may include crystals, aromatherapy, and flower essences. 2.2 Our Services are alternative and complementary wellness practices. They are not medical, psychological, or mental health care. Our practitioners are not licensed by the State of California as healing arts practitioners. We do not diagnose, treat, or cure any condition, prescribe medication, or advise changing any treatment prescribed by a licensed provider. Coaching is not therapy or counseling. 2.3 Before your first Service, you must sign our written disclosure and acknowledgment form. You must also complete any intake form or activity waiver we require. We may decline or end Services if you do not. 2.4 You are responsible for consulting your health care provider before any movement class. You must also tell us about any condition, injury, pregnancy, or allergy (including to essential oils or fragrances) relevant to your participation. 2.5 If you are in crisis, call or text 988, or call 911. Our Services are not emergency services.3. Booking, Payment, and Cancellation
3.1 You may book Services through our third-party scheduling provider. Prices are as posted at booking. Payment is processed by our third-party payment processor under its own terms. 3.2 Cancellations, rescheduling, no-shows, and refunds are governed by our Cancellation and Rescheduling Policy, which is part of these Terms. 3.3 We may refuse or end Services to anyone whose conduct is unsafe, disruptive, or inconsistent with a respectful environment. If we end a Service for that reason, no refund is owed.4. Acceptable Use of the Site
You agree not to: (a) use the Site for any unlawful purpose; (b) submit false information or impersonate anyone; (c) interfere with the Site's operation or security; (d) scrape, copy, or harvest Site content or user data by automated means; or (e) send spam or harmful code through our forms.5. Intellectual Property
The Site's content belongs to Marigolden or its licensors and is protected by intellectual property laws. This includes text, graphics, logos, photos, class materials, and recordings. You may view and print Site content for personal, non-commercial use. You may not reproduce, distribute, or create derivative works without our written permission. You may not record any Service without our consent.6. Your Submissions
If you send us testimonials, comments, or other content, you grant us a non-exclusive, royalty-free license to use it for operating and promoting Marigolden. We will use your name or likeness only with your separate consent.7. Third-Party Services and Links
The Site links to and relies on third-party services, including scheduling, newsletter, hosting, payment, and social media platforms. We do not control them and are not responsible for their content, policies, or practices.8. Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE ANY PARTICULAR HEALTH, WELLNESS, EMOTIONAL, OR PERSONAL RESULT FROM ANY SERVICE.9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MARIGOLDEN AND ITS OWNERS AND PRACTITIONERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE OR SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM. THIS SECTION DOES NOT LIMIT LIABILITY FOR GROSS NEGLIGENCE, FRAUD, WILLFUL MISCONDUCT, OR ANYTHING THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.10. Indemnification
You agree to indemnify and hold harmless Marigolden and its owners and practitioners from claims, losses, and expenses, including reasonable attorneys' fees, that arise from your breach of these Terms or your misuse of the Site.11. Governing Law and Dispute
California law governs these Terms, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and try in good faith to resolve the dispute informally for 30 days. Any claim that is not resolved must be brought in the state or federal courts in San Diego County, California. Either party may instead bring an eligible claim in small claims court.12. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on the Site with a new effective date. Changes do not apply to Services already booked. Your continued use of the Site after an update means you accept the revised Terms.13. General
If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms, our Privacy Policy, our Cancellation Policy, and any signed forms are the entire agreement between you and us about the Site and Services. If they conflict, the signed forms control.14.
